NEHRA Webinar Series: After the H-1B Cap: Employment, Immigration, & Travel Considerations

The presentation will provide an overview of the employment, immigration and travel issues facing foreign national employees and candidates after an H-1B Cap petition is filed on their behalf.  We will provide guidance on identifying common issues that arise with foreign national employees working pursuant to student visas, including an overview of the STEM program and "Cap Gap."  We will discuss when foreign national candidates can begin employment with your company, as well as the risks associated with hiring a candidate who has a pending or approved H-1B Cap petition with another company.  We will address the impact of changes in employment, including changes in title, work location and/or salary, on foreign national employees who have a pending or approved H-1B Cap petition. We will also offer immigration alternatives to consider if your employee or candidate is not selected in the H-1B Cap lottery.  Finally, we will provide an overview of the potential changes to the H-1B Cap lottery and STEM program.
